DMHOA ARB Form and ARB Guides

If you are making any changes/additions to your home’s exterior and/or property, you must submit an application for ARB approval. This includes any changes in elevation or drainage. Building permits cannot be obtained without an ARB or Board approval. Click HERE  for the complete ARB application. These will outline the exact specifications of what is permitted. These documents were to be provided to you at the closing of your home by the seller.

Application Procedure

The DMHOA ARB Form now includes approval of HARDIEPLANK as an alternative to vinyl exterior siding under certain circumstances. The only candidates for HARDIEPLANK are buildings that had nothing done to the siding by either owner. 2)    Go to your Owner's Portal at Empire Management Group for new instructions to submit an ARB.

Please remember, the ARB Committee has 30 days to inform you of their decision.  No work can commence until your request is approved.

Siding - If one homeowner has already replaced the siding, the second attached homeowner must replace the siding with one similar to and of the same color as the first.

Garage Door Window Inserts- Please note that if you have window inserts on your garage door and they break you must replace them with the same type of inserts.

Violations  - To avoid a violation, here are some of the things the Management Company looks for during their monthly inspection.The list below is for convenience and not intended to be all inclusive. Please refer to your Declaration of Covenants, Conditions, and Restrictions, Article 7, located in our Governing Documents on our website and your owner's portal for additional information.

  • Mildew/Dirt on Roofs, House, Driveways, Sidewalks
  • Oil stains on Driveways
  • Overgrown lawn and/or weeds or weeds in planter beds
  • Exterior painting/repair needed
  • Basketball hoops not stored in garages when not in use
  • Garage doors not painted to match body color of home
  • Trash cans/recycling bins left on driveway or not stored out of view
  • Exterior changes performed without prior approval from the ARB Committee
  • Structures of temporary nature or character such as trailers, boats, tents, etc. being stored on homeowner's premises

These are a few easy-to-take-care-of things.  If you have received a violation, please contact Empire Management Group through your Owner's Portal under your violation's tab to let them know when you will have the requested work completed. 

Violation Policy - The covenant inspections will be performed on a monthly basis by the LCAM/Compliance Committee. Notices will be issued to the membership advising of the type of regulation, required solution, and time allowed to correct the violation.

The association will provide the membership 3 total notices requesting the violations be cured.

     1) First Notice (Courtesy Notice) allowing 30 days to cure.

     2) Second Notice allowing 30 days to cure.

     3) Third Notice issued via certified mail allowing 30 days to cure.

Any violations that remain unresolved after the 90 day period outlined above will be escalated to the Homeowners Association Attorney for further enforcement. All legal fees associated with the legal enforcement will be the owner's responsibility.

If mediation is required, each party is responsible for their fair portion of the mediation.

ALTERNATIVELY IF A FINE COMMITTEE IS IN PLACE:

Step #4: Any unresolved violations are presented to the Board for approval of Fine and Hearing Committee invitation.

Important - If you have received a notice from Empire Management Group, stating your file is being sent to our Attorney, it is imperative you call Empire as soon as possible.  Once your information is sent to the Attorney, the Management Company, and your Board of Directors are limited on assistance it can offer.
