 Article VII / General Restrictions

Activity:

No obnoxious or offensive activity shall be conducted or permitted to exist upon any Lot, or in any Dwelling Unit, nor shall anything be done or permitted to exist on any Lot or in any Dwelling Unit that may be or may become an annoyance or private or public nuisance.

No Lot, Driveway, or Common Area shall be used for the purpose of vehicle repair or maintenance.

Animal Control: Danbury Mill and Seminole County Rules on Animal Control:

Our community by-laws on the subject of animal control are consistent with Seminole County. Seminole County rules on animal control state the following:

Section 4-12 (Animals At-Large Prohibited; Custody and Confinement Authorized) states the following:

(a)     It shall be unlawful for any animal owner to allow his animals to run at-large upon public property, or upon private property of others, including common areas.

(b)    When any animal is found at-large anywhere within the County, whether licensed or otherwise, and whether owned or otherwise, said animal may be taken into custody by the Animal Welfare Officer or other law enforcement officer to be impounded at the Animal Shelter.

Sec.4-14 Urinating and Defecating

It shall be unlawful for any animal owner to permit, either willfully, or through failure to exercise due care and control, any animal to soil, defile, urinate, or defecate on any private or public property, other than that of the owner.

Danbury Mill's covenants state the following on animal control:

No livestock, poultry, or animals of any kind or size shall be raised, bred, or kept on any Lot or in Dwelling Unit provided, however, that dogs, cats, or other common domesticated household pets may be raised and kept provided such pets are not kept, bred or maintained for any commercial purposes. Such permitted pets shall be kept on the Owner's Lot and shall not be allowed off the premises of Owner's Lot except on a leash. No permitted pet shall be allowed to make noise in a manner or of such volume as to annoy or disturb other Owners.

This pertains to a neighbor's yard, as well as all common areas and private property. The animal owner is solely responsible for clean up. The offense is a second-degree misdemeanor, punishable by 60 days in jail and/or $500 fine. Offenders can be reported to our management company, or Seminole County Animal Control (407-323-2500).

Construction and Alteration:

No building, fence, wall or other structure shall be commenced, erected or maintained upon the Property, nor shall any exterior addition to or change or alteration therein nor any change of exterior finishing color be made until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography by the Board of Directors of the Association, or by an Architectural Review Board (ARB).

House Trim [Allowable]:

No owner or tenant of an Owner shall install shutters, awnings, or other decorative exterior trim, except small exterior decorations such as address plates and name plates, without the ARB's approval.

Lawn Maintenance:

Danbury Mill restrictions require that all yards are to be mowed and maintained in a clean and orderly condition and free from overgrown shrubs and weeds. Yard maintenance not only requires consistent mowing, but also watering, trimming, weeding, mulching, edging, etc. The front, side and rear yards of all Lots in Danbury Mill shall be sodded, except paved areas, patios, shrubbery and flowerbeds.

Lot Use:

No Lot shall be used for any purpose except residential. The term "residential" is intended to prohibit any commercial use, including professional office use of any portion of any Lot or Dwelling Unit.

Miscellaneous Restrictions:

Window air conditioners, tankless water heaters, and external mechanical equipment are prohibited. External water softeners shall be screened from view. Basketball hoops are prohibited.

Trash Cans:

Household trash pick-up is Monday and Thursday. Yard waste is collected on Wednesday.  Trash cans are to be placed at the end of the driveway the evening before and removed by the evening of pick-up.  All trash cans must be stored in your garage or behind your fence, out of sight.

Parking:

No automobile, truck, boat, boat and trailer, trailer, house trailer, mobile home, camper, or other similar vehicle shall be parked on the street, including right-of-way thereof, overnight or for a continuous period of time in excess of ten (10) consecutive hours. Vehicles parked on the street between the hours of 1 AM - 7 AM will be towed at the owner's expense. Call C & J Towing at (407) 260-2038 if you have been towed.

Pool and Tennis Facilities:

Pool hours are 7:00 a.m. to 10:00 p.m. Tennis hours are 7:00 a.m. to 10:00 p.m. All trespassers will be arrested and prosecuted to the fullest extent of the law.

Recreational Facilities of Danbury Mill:

The Association may suspend the voting rights and right to use the recreational facilities by a property owner for any period during which any assessment against his Lot remains unpaid; and for a period not to exceed sixty (60) days for an infraction of its published rules and regulations.

Signs:

No commercial signs, or other signs, shall be erected or maintained on any Lot or Dwelling Unit except with the written permission of the Association. Such prohibition shall not apply to common commercial real estate signs advertising that a particular Lot or Dwelling Unit is for sale provided that such signs are not illuminated and do not exceed four (4) square feet.

Storage:

No automobile or pickup truck shall be parked for any period of time in excess often (10) consecutive hours or stored or otherwise permitted to remain on any Lot except in a garage attached to a Dwelling Unit or within the confines of a paved driveway. No automobile which contains lettering or advertising thereon or which is identified with a business or commercial activity, truck or other commercial vehicle, house trailer, recreational vehicle, mobile home, camper, boat, boat and trailer or other similar vehicle shall be parked for any period of time in excess of four (4) consecutive hours or stored or otherwise permitted to remain on any Lot except in an enclosed garage.

Temporary Structures:

No structure of a temporary nature or character (including, but not limited to, a trailer, house trailer, mobile home, camper, tent, shack, shed, boat, barn or other similar structure or vehicle) shall be used or permitted to remain on any Lot as a storage facility or residence or other living quarters whether temporary or permanent.

Wall, Fences or Hedges:

No wall, fence, or hedge over six feet (6 ft) tall as measured from existing ground level shall be erected, placed, altered, maintained, or permitted to remain on any Lot unless and until the height, type or location thereof have been approved by the ARB in accordance with Article V hereof.

Window Coverings:

No reflective foil, or other materials or tinted glass shall be permitted on any windows except for non-reflective bronze, smoke, or gray tint, and any such installation shall require approval of the ARB.
